The Court of Appeal sitting in Nairobi ruled that Governors Ferdinand Waititu of Kiambu and Moses Lenolkulal of Samburu must remain out of office as their cases on corruption are still before the court of law. Tanga Tanga leaders now claim the decision by the Court of Appeal to uphold Justice Mumbi Ngugi’s ruling will be used to hunt down and eject from office Governors supporting DP William Ruto.
”Listen, are you a Governor and you support the TangaTanga political wing?Trust me we know you support TangaTanga. After the decision by Court of Appeal today, my unsolicited advice is keep off public statements supporting TangaTanga. There is a new way to remove a Governor from office, it is NOT in the constitution. It is Karura,” DP Ruto’s social media hatchet man Dennis Itumbi writes.
”Directorate of Criminal Investigations – DCI investigations- their quality, strength or depth not withstanding!They just need to say you are under their radar, have you charged as they investigate and you are no longer a Governor!You cannot access your office, it is a scene of crime, not the type that no-one can access, just the type YOU cannot access.So far the selective prosecutions have only pinned allegations on Governors believed to support TangaTanga,” he added.
The three-judge bench sitting in Milimani on Friday ruled that elected executives cannot continue attending office when facing corruption-related charges.On July 24, High Court Judge Mumbi Ngugi ruled that governors facing corruption charges should step aside until their cases are concluded.“What message does it send to the citizens if their leaders are charged with serious corruption offences and are in office the following day, overseeing the affairs of the institution?” she said.
Sitting in Milimani on Friday, Court of Appeal judge Jamila Mohamed said there are incidents where vital documents were lost after officers charged with economic crimes were allowed access.
