Mombasa Governor Ali Hassan Joho faces a six (6) months in prison for being in contempt of court orders.
In a ruling that was delivered via a video link by Justice Sila Munyao, the High Court dismissed an application by the Mombasa Governor who was seeking to stop his sentencing to a six month jail term.
The Mombasa Governor had ignored court orders stopping demolition of a multi-million-shilling property in Changamwe.
According to Justice Munyao, Governor Joho was aware of the injunctive court orders barring the demolition of the property belonging to Mombasa tycoon Ashok Doshi.
The judge said that Joho had been served with a notice to show cause dated May 17, 2019 but ignored. This is because Joho was well represented by his lawyers.
Having ignored, Joho was found guilty of contempt of court.
Joho’s lawyer Ali Mohamed said the application dated May 17, 2019 was never personally served on him and as such, he is a stranger to the court proceedings.
Justice Munyao said that he was not persuaded that Joho was not served with the application. More directions on the sentencing will be given on May 27.
