Hours after a warrant of arrest was issued against him by a Machakos Court, Machakos County Governor Dr. Alfred Mutua has finally opened up issuing a statement.
The Machakos Environment and Lands Court earlier Today Wednesday September 1, 2021 issued a warrant of arrest against the County Chief for failing to pay a sum of Sh5.5 million to businessman David Gitau.
Court documents indicated that the warrant of arrest was for failure by the Machakos County government under his tenure to pay the sum of the money due for encroaching into and dumping wastes in Gitau’s land.
“These are to command you to arrest the said Governor, County Government of Machakos and unless they shall pay to you the sum of Kshs 5,590,443.15,” said the Machakos Environment and Lands court Principal Magistrate C.N Ondieki.
In his response to the warrant of arrest, Governor Mutua noted being aware of the warrant, and clarified that it was not directed to him as an individual, but rather his office.
In a rejoinder, Governor Mutua stated,” I have been notified of a warrant issued by the Machakos Environment and Lands Court for me to appear before it.
“I wish to clarify that the warrant is not directed to me as a person BUT to my office as the Governor of Machakos. This is normal in government.”
Governor Mutua added that the County was willing to pay the sums of money once the funds are available, adding that he was no liable for the mistakes of the County as an individual.
“This is especially so because the county is willing to pay once funds are available and further that as Governor I’m not liable for the mistakes of commission or omission of officers in the county government.
“I’m a believer in the rule of law whose core tenet is obedience of court orders.” Added Governor Alfred Mutua
In the Court papers, the County was was listed as the first respondent, Governor Mutua the second and the Attorney General the third respondent to the suit.
The Judge further asked the Machakos OCS to avail the governor as soon as possible, with the complainant through his lawyer Lawrence Nyangito asking the court to sentence Mutua to a civil jail term for contempt of court after he refused to pay the directed sums of money.
