Big blow to Independent Electoral and Boundaries Commission (IEBC) as the High Court ordered the commission to issue the Orange Democratic Movement (ODM) party with a complete Kibra voter register with voters’ complete details in compliance with the law.
The commission, however, stated that it will be a challenge to comply with the order and requested for 10 days saying they have already taken materials to Kibra polling stations and it will be a big challenge to supply the ODM party with the voter register before the Kibra by-election.
IEBC’s through their lawyer said, “If we are to print the register, then it will be a great challenge. We cannot contact Delarue in the next two hours.”
ODM through their Lawyer, however, opposed IEBC request, arguing that the process is an automated one and that the IEBC need only click a button and all information will be availed stating “The arguments are evasive if you grant orders of stay you would basically have declared your judgment redundant.”
Justice James Makau declined IEBC’s request to be given more days to supply the ODM party with voter register but ordered the commission to supply the register before the by-election as they have few hours to comply.
