The Environmental and Land Court has issued a warrant of arrest for Machakos Governor Alfred Mutua after he failed to pay a businessman an amount over Ksh.5.5million.
Governor Mutua was on July 30, 2021 ordered to pay businessman David Gitau Ksh. 5,590,443.15 over a dumpsite case.
The court ordered the OCS Machakos Police station present Mutua in court as first as they can.
“These are to command you to arrest the said Governor, County Government of Machakos and unless they shall pay to you the sum of Ksh. 5,590,443.14 as noted in the margin, together with executing officer’s expenses and fees if any to bring the Governor, County Government of Machakos before the Court with all convenient speed,” judge Ondieki directed.
Businessman Gitau sued Mutua for dumping waste on his piece of land in Machakos.
The Governor, however, ignored a high court order barring him from dumping waste on the businessman’s land leading to the lawsuit.
He then sought the court intervention, stating that he suffered immense losses and has not been compensated despite the court directing so.
While responding to the warrant, Mutua insisted that the arrest was not directed at him but his office as Machakos Governor.
