Barely five months after the Supreme Court under Chief Justice Martha Koome made a ruling to uphold William Ruto’s presidential victory much to the chagrin of the Azimio La Umoja One Kenya Alliance Coalition Party, the opposition outfit has been dealt another blow from the arbiter.
A ward seat held by the United Democratic Party under the Azimio coalition has been lost through a court injunction.
Speaking when she made the decree, Chief Magistrate Dolphina Alego cited malpractice in the polls and failure to adhere to election guidelines by IEBC officials.
A Kakamega Court has nullified the election of Amutete Grey Moi as Lugari Member of County Assembly (MCA)
This comes after one of his competitors, William Libombolo of the MDG Party, moved to court to challenge Moi’s August 9, 2022 victory on grounds that he did not win fairly.
Delivering the ruling, Chief Magistrate Dolphina Alego cited malpractice and failure to adhere to election guidelines by IEBC officials.
In his petition, Libombolo through his lawyer claimed that his agents were barred from accessing polling stations and that Moi was unfairly awarded an extra 181 votes.
Following the ruling, Alego instructed IEBC to organise a repeat election for Lugari Ward.
Chief Magistrate Alego similarly dismissed the nomination of Amos Munasya as Kakamega County Assembly’s nominated MCA for ODM.
This is after ODM’s Geoffrey Mitalo filed a complaint claiming that the party did not follow due process when making the nomination
The Supreme Court on Monday 5th September upheld the Aug. 9 election of William Ruto as president in a unanimous decision, Chief Justice Martha Koome said in a scathing judgement that swept aside opposition leader Raila Odinga’s accusations of cheating.
“This is a unanimous decision of the court … This court upholds the election of the first respondent (William Ruto) as the president-elect,” Koome, who heads the seven-member court, said during a televised ruling.
Ruto had been serving as outgoing President Uhuru Kenyatta’s deputy since 2013 but fell out with Kenyatta after the last election. Kenyatta formed an alliance with his long-time rival Odinga.
