Chaos in Cherera Hearing as Azimio Demand for Postponement of the Hearing

On November 24, Azimo La Umoja Members of Parliament led by Junet Muhamed disrupted the Justice and Legal Affairs Committee (JLAC) meeting meant to kick out Juliana Cherera, Irene Masit, Justus Nyang’aya and Francis Wanderi from the Independent Electoral and Boundaries Commission.

The pro-Raila Odinga legislators voiced preliminary objections, pointing out that it was unlawful for the committee to consider a case that was already in court.

“Chair, these people who we are discussing do have the capacity to respond to the allegations,” Suna East MP Junet Mohamed lamented.

Danstan Omari, who is the legal counsel for Juliiana Cherera, Francis Wanderi, Justus Nyang’aya, and Irene Masit presented legal objections to the proceedings causing arguments. The arguments happened as the top Azimio leaders, including Raila Odinga watched.

TJ Kajwang, the Ruaraka MP, requested that the hearing be postponed until all outstanding preliminary objections are addressed and decided.

Kajwang lamented that the process to kick the four commissioners out of IEBC will be illegal if there is no fair hearing accorded to them.

On Wednesday the 23rd of November 2022, the Orange Democratic Party Leader, Raila Odinga invited the media to speak about the four Independent Electoral And Boundaries Commissioners only for the Press to be called off a few minutes later.

According to Standard Digital, Raila Odinga’s press team had invited media to the Jaramogi Oginga Odinga Foundation in Upper Hill, Nairobi at 2 pm for the press conference. But later on, the Press was canceled citing that they wanted to give the Parliament time to deliberate on the matter.

Raila Odinga’s communications director Dennis Onyango said that Raila Odinga canceled the press conference to allow the process which is before the Parliament to proceed without prejudice.

“To allow other processes currently underway about a summons to IEBC commissioners to proceed without prejudice, Raila Odinga will not address the subject as earlier announced. Our apologies for the cancellation,” Odinga’s communications director Dennis Onyango Quoted.

Raila Odinga was set to address the plot by some members of Parliament seeking the removal of IEBC Vice-chairperson Juliana Cherera and three other commissioners from office.
