Man Arrested for Infecting His Girlfriend with HIV

A 47-year-old farmer has been brought before the court on charges of deliberately infecting a woman with HIV

The accused, identified by the initials T.C.K., stands accused of committing this egregious act between October 5, 2022, and June 30, 2023.

The case, presented before Milimani Chief Magistrate Bernard Ochoi, took a significant turn when the Director of Public Prosecutions (DPP) requested the proceedings to be conducted in camera, citing the sensitivity of the charges.

Senior Assistant DPP James Gachoka emphasized the need to protect the victim’s privacy, highlighting the gravity of the situation and the potential harm caused.

The allegations against T.C.K. are grave. It is claimed that he knowingly engaged in unprotected sexual intercourse with the victim, Z.K.W., despite being aware of his HIV-positive status

The legal framework under which T.C.K. is being charged is the Sexual Offenses Act of 2006, specifically Section 26(1)(b), which deals with deliberate transmission of HIV.

“T.K.C., having actual knowledge that he was infected with HIV disease intentionally, knowingly, and wilfully, had unprotected sexual intercourse with Z.K.W, knowing that the act was likely to infect her with the virus,” read the charge sheet.

The court directed that he be remanded in police custody, after which he will appear on Tuesday, February 20.
