MP Babu Owino, Gaucho Released on Cash Bail

As of July 21, 2023, Embakasi East MP Babu Owino has been released on bail by the Milimani Law Courts.

The judge declined to detain him further, stating that the prosecution failed to prove how Babu would interfere with witnesses if released.

He was granted bail with the amount set at Sh100,000 and an alternative option of Sh200,000 bond.

“A look at the affidavit does not disclose compelling reasons to deny the accused person bond, each of the accused persons is granted a bond of Sh 200,000 with an alternative cash bail of Sh 100,000,” Milimani chief magistrate Lukas Onyina ruled.

Babu Owino had been charged with conspiracy to commit subversive activities.

Alongside him, another supporter of ODM leader Raila Odinga, Calvin Okoth alias Gaucho, was also released on bail.

Both individuals were accused of committing the offence between July 7 and July 23, 2023, within Nairobi City County.

Several other individuals, including Tom Odondo, Michael Otieno, Pascal Ouma, Kevin Wambo, and Willys Owino, faced similar charges and were also released on bail.

Babu Owino’s arrest took place on Tuesday evening around 8 pm at JKIA while he was on his way home from Mombasa.

He was initially held at JKIA Police Station and later reportedly taken to Wanguru Police Station in Mwea, Kirinyaga County.

After spending time at the police station, he was released and subsequently brought to Nairobi where he was arraigned more than 24 hours later.

The law requires suspects to be arraigned within 24 hours after being arrested, and in Babu Owino’s case, this requirement was met despite the delay in his arraignment.
