President Uhuru Kenyatta and the Judiciary have been at war for the past few years. The President has faulted the Judiciary for failing to protect the rights of Kenyans as prescribed in the constitution of Kenya.
A few days ago the Judiciary landed Uhuru another major blow after a five-man bench ruled against the BBI report. The High Court ruled that the BBI steering committee is unconstitutional and that nothing legitimate can come out of it.
The court also declared that the President cannot initiate a constitutional amendment process under the current constitution thus making the whole process null and void. The decision has not settled well with President Kenyatta who has since warned the Judiciary against overturning what he terms as the will of the people.
A few days ago the President appointed 34 New judges out of the 40 judges that had been recommended by the JSC. Two of the six judges who were declined by Uhuru happen to be Judges George Odunga and Joel Ngugi who coincidentally sat on the five-judge bench that declared BBI unconstitutional. Many have interpreted Uhuru’s actions as a Breach of the same constitution he vowed to protect.
Fellow BBI Principal Raila Odinga has been very silent on the issue. The ODM leader has managed to successfully keep a low profile during the ongoing turbulence.
However, according to the Daily Nation newspaper, the ODM leader and his party support the President’s decision. According to the newspaper, The ODM Leader is of the opinion that the JSC should take up the President’s Memo where he explained the reason for rejecting the six and help the Public to understand the situation.
