Ex- Kisumu County Speaker Onyango Oloo faces arrest

Ex-Kisumu County Speaker Onyango Oloo is facing warrant of arrest after he failed to appear in court over Ksh 4.1 Million Lake Basin Development Authority Mall fraud case.

A Nairobi court has issued a warrant of arrest for former Kisumu County Speaker Onyango Oloo over fraud case amounting to 4.1 Million for Lake Basin Development Authority Mall.

The former Kisumu County Speaker has been ordered to appear in court on May, 3, 2021.

Mr. Oloo is currently facing eleven new charges in the amended charge sheet filed in court by the office of the Directorate Public Prosecutor (DPP).

However, the charges raised against 14 others accused persons who had been charged in connection with the case have been dropped.

The 14 accused persons will appear in court as state witnesses.

According to the public prosecutor, the politician was accused of inflating the cost of the Lake Basin Development Authority Mall from the initial cost of Ksh 2.5 billion to Ksh 4.1 billion in violation of procurement laws and the Anti-Corruption and Economic Crimes Act.

  1. Evidence showed that the conditions precedent to the impeachment of a speaker had been met. A formal notice issued to the Clerk of the County Assembly stating the grounds of removal and bearing the signature of 29 members from the County Assembly was filed and served on the petitioner via e-mail. The petitioner was invited to attend the hearing of the motion on September 18, 2019 at 2:30 pm. The proceedings were presided over by a member elected in accordance with the law and a resolution to remove the speaker was passed by 42 members of the county assembly and that number constituted at least 75% of the membership of the assembly. On a balance of convenience, it was important to uphold public interest as a major consideration in the matter. The petitioner prayed for reinstatement as speaker. The court was conscious of the corruption case being faced by the petitioner and the fact that the petitioner was to be presumed innocent until proven guilty.
