City Lawyer blasts government, says those forced into quarantine will sue the state

    Lawyer Donald B Kipkorir has poured cold water on the government’s forced quarantine move, saying a person can only be isolated pursuant to Certificate by a Medical Officer and a Court Order. Kipkorir adds the government is fighting coronavirus without legal tools.

    ”Under our Public Health Act, a person suspected of having infectious disease can only be isolated pursuant to Certificate by a Medical Officer & a Court Order & the costs of the isolation shall be borne by the local authority. Kenya is fighting Coronavirus without legal tools,” the lawyer tweeted.

    He has also added that those forced into hotels and institutions are likely to sue the for false imprisonment and government will pay billions of shillings.

    ”When the dust settles, those forced into Hotels & Institutions at own cost will sue GoK for false imprisonment & GoK will pay Billions,” he said, adding that President Uhuru should invoke emergency powers allowing him to rule by decree.

    ”I advised that the President invokes Emergency Powers to allow him Rule by Decree thus bypassing existing legislation. But then, we ignore.”
