Impeached Kiambu Governor Ferdinand Waititu is currently in court fighting tooth and nail to block his Deputy, James Nyoro from being sworn in as the new Kiambu Governor. The ousted governor is currently at Milimani Law Courts where he has filed an application under a certificate of urgency at the constitutional division of the High Court against his impeachment.
Separately, Tanga Tanga politicians led by Elgeyo Marakwet Kipchumba Murkomen have called the swearing in of James Nyoro an illegality if it proceeds, saying a High Court judge cannot swear in a governor.
” A High Court Judge cannot preside over swearing in of DG of Kiambu to be a Governor before 10 days are over and before they Gazette the date, time and place for conducting the swearing in Ceremony. But you know what ? Everything is working like a clock in the new Kenya,” Murkomen said.
However, in a rejoinder, Senator Mutula Kilonzo Jr rubbished Murkomen’s claims, saying DG Nyoro’s swearing is in accordance to the law and can be conducted by a High Court judge.
” Boss , you and I approved this bill in reference to Assumption of office after a General Election. In Kiambu, a vacancy has occurred under Art 182 and the deputy shall assume office under 182(2). Needless to say , I agree with you that we are back into a working nation,” the Makueni Senator retorted.
The embattled governor was shown exit door after majority of the senators who were present during the hearing of his impeachment motion voted voted for his ouster. Among 39 Senators who took part in the Kiambu Governor’s impeachment motion, 28 Senators voted for his removal while only 11 members voted against it. Waititu has been accused of corruption, gross violation of the Constitution, County Government Act and, Public Finance Management Act.
