There is tension in government following a revelation that DPP is finalizing his findings on the Ruaraka Land Scandal and he has already identified top State officials for prosecution. The DPP has been burning midnight oil trying to establish the irregularities in wiring of Sh1.5 billion to businessman for the acquisition of the public land at Drive Inn, along Thika Road.
“The courts have ruled on the real owners of the land. We now have the green light to proceed. It is only a matter of days before you see the next action,” he said.
A number of senior public officials including a PS and CS have been adversely mentioned as having authorized the illegal 1.5B transaction at the advise of the National Land Commission, which was led by Mohammed Swazuri at that time.
“We find that NLC misled the Ministry of Education to undertake a compulsory acquisition, which led to loss of public funds. You cannot seek to compulsory acquire what is already public land, their advice to the Ministry of Education was irregular and illegal,” ruled the judges of Environmental Court in June.
In a report tabled to parliament this year by the Auditor General Edward Ouko, the Ministry of Education was supposed to purchase the piece of land from business man Francis Mburu and had already paid 1.5B of the 3.2B Mburu demanded.
“The Ministry of Education transferred Sh1,500,000,000 to the National Land Commission on January 22, 2018 for the purpose of the acquisition and the same was paid to the vendor on January 29, 2018 vide cheque number 000936,” read the report.
NLC chair Mohammed Swazuri has already been implicated in a number of corruption related scandals as well as questionable expenditure of more than Sh908 million for compensation of various parcels of land.
With the DPP’s revelation that they are going after suspects of the land scandal, it is a tough time in President Uhuru’s cabinet. Pundits believe, corruption related charges being leveled on prominent Cabinet Secretaries and top state officials has presented President Uhuru Kenyatta the right opportunity to overhaul his entire government.
