The Uber driver accused of sexually assaulting a 13-year-old boy as he drove him home from school in Nyali, Mombasa has been freed on Sh50,000 cash bail.
Fredrick Mungai Njenga on Wednesday appeared at the Shanzu Law Courts but did not take plea after the court faulted the wording on the charge sheet.
“According to law it is not “indecent act” since mouth is not a genital organ. Get a proper charge,” Senior Resident Magistrate Yusuf Shikanda told the Prosecution.
He ordered that the charge sheet be written afresh and the suspect to reappear in court on July 23 for plea taking.
Njenga is accused of forcing the class 8 pupil to lick his private parts after locking him inside his car.
The 33-year-old driver was arrested on Tuesday after the boy’s mother filed a complaint accusing him of forcing her son to lick his private parts.
She revealed that an Uber taxi had been scheduled to pick up the Class 8 boy from school and drop him home at around 6pm.
It is alleged that after the driver picked up the boy, he stopped the car by the side of the road–about 50metres from the boy’s home–and locked the windows and the doors.
The boy’s aunt who had requested the Uber taxi is said to have become concerned after the taxi took too long.
She went out to look for the car and found it parked a few meters from the house.
When she asked the driver what had happened, he allegedly told her that the boy had forgotten where his home is.
The boy was taken to the Coast General Hospital.
