The case of Weston Hotel hotel has kicked off.Kenya Civil Aviation Authority (KCAA) wants the facility demolished,accusing the hotel of dispossessing the agency of its land with impunity and in collusion with two private entities and the National Land Commission.
Deputy President’s lead counsel Ahmednasir Abdullahi now want KCAA lawyers Otiende Amollo and James Orengo thrown out of the case because they are both lawmakers and as such are barred by law from prosecuting cases in court. Otiende Amollo represents Rarieda as its MP while James Orengo is the Siaya Senator.
“I will be filing an application seeking to have the applicant’s lawyers withdraw from the case. The issue to be determined will be whether members of an arm of Government can represent parties. He is a leader of the minority and is expressly prohibited by the Constitution,” said Ahmednasir, who also argued that the case against Weston Hotel was politically motivated, to paint DP Ruto in bad light.
However, in response, Senator Orengo laughed off lawyer Ahmednassir’s threats to have him thrown out of the case.The Senior Counsel said similar attempts have been made in the past to have him barred from cases for being a lawmaker had failed.
As to the application my learned friends wants to file, many have been filed against me without success,” he argued.
KCAA had filed a petition before the Environment and Land court arguing that the Langa’ta Road land on which Weston Hotel sits, was owned by the Directorate of Civil Aviation, which was succeeded by KCAA, and the corporation was pursuing its registration to build its head office.The case will come up for hearing on October 13th,
